Bases legales de la promoción “Ayúdanos a mejorar y gana 300 € en el Wallet de Civitatis”Primera. -EMPRESA ORGANIZADORA, OBJETO, DURACIÓN Y ÁMBITO

La organización del sorteo promocional está promovida por la empresa Civitatis Tours S.L. (en adelante, “CIVITATIS”) con domicilio en Calle Coloreros 2, 28013, Madrid y N.I.F B- 86899440.

CIVITATIS organiza, con fines promocionales el sorteo “Ayúdanos a mejorar y gana 300 € en el Wallet de Civitatis” (en adelante, la “Promoción”) de ámbito internacional, a desarrollar a través de Internet, cuya participación está abierta a participantes mayores de edad.

La Promoción se iniciará el 10 de marzo de 2020 y finalizará el 21 de marzo de 2020.

No obstante lo anterior, CIVITATIS se reserva el derecho de modificar a su conveniencia las fechas de la Promoción.

Segunda. – REQUISITOS DE PARTICIPACIÓN

Podrán participar en la promoción todas aquellas personas (en adelante, los “Participantes”) que acepten las presentes Bases Legales y cumplan las siguientes normas de participación:

• Cumplimentar correctamente la encuesta de satisfacción recibida en su correo electrónico con CIVITATIS como remitente en el plazo establecido.
• Ser mayor de 18 años.

Tercera. – PREMIOS, CONDICIONES DE LA PROMOCIÓN Y FORMA DE CANJE

En concreto, se seleccionará al ganador realizando un sorteo mediante la aplicación EasyPromos entre los usuarios que hayan cumplido los requisitos de participación. Los Participantes que no hayan seguido todos los pasos de la dinámica quedarán automáticamente eliminados del sorteo. Cualquier perfil que se detecte como falso o que cometa actos fraudulentos también se eliminará del sorteo.

Una vez CIVITATIS tenga conocimiento de quién es el ganador, lo comunicará a partir del 21 de marzo de 2020 contactando directamente con él a través de un mensaje de correo electrónico.

El premio de la presente Promoción, concretamente, incluye:

– Recarga de 300 € en el Wallet de Civitatis.

En cuanto a las condiciones del premio: (i) el premio es intransferible y no podrá ser canjeados por dinero en efectivo u otro producto, (ii) el premio solo podrá ser canjeado por actividades de CIVITATIS siempre de acuerdo a la disponibilidad de las mismas.

Si el ganador no pudiera ser localizado o contactado dentro de los siete (7) días naturales siguientes a la fecha de la comunicación de CIVITATIS, el premio será otorgado al siguiente en el tiempo en cumplir con los requisitos de participación y se entenderá que el primer ganador renuncia de forma irrevocable al premio concedido. En caso de que no pudiese localizarse al Participante suplente en un nuevo plazo de siete días (7) naturales desde la comunicación remitida por CIVITATIS el premio quedará desierto.

Correrán a cuenta y cargo del ganador cualesquiera cargas tributarias que la aceptación del premio pudiera suponerle, así como cualquier otro gasto derivado de la Promoción que no esté expresamente asumido por CIVITATIS en las presentes Bases Legales.

Cuarta. – LIMITACIONES

No podrán participar en la Promoción las siguientes personas, ni sus cónyuges ascendientes o descendientes hasta el segundo grado (inclusive): (i) Los trabajadores por cuenta ajena empleados en cualquiera de las sociedades y otras entidades con personalidad jurídica vinculadas a CIVITATIS, (ii) Las personas físicas que participen directa o indirectamente en el capital de CIVITATIS, (iii) el Notario designado para la protocolización de estas bases, ni ninguno de los empleados de dicha Notaría y (iv) Cualquier otra persona física que haya participado directa o indirectamente en esta Promoción o haya estado involucrado directa o indirectamente en su preparación o desarrollo (agencia, proveedores, etc.).

Al aceptar estas Bases Legales, los Participantes consienten que CIVITATIS excluya o descalifique estas participaciones de la Promoción.

Se considerarán nulas aquellas participaciones que se hayan realizado posteriormente a la fecha de finalización de la Promoción, así como las que no cumplan con los requisitos establecidos en el apartado segundo de las presentes Bases Legales. CIVITATIS se reserva el derecho de excluir de la Promoción a aquellos Participantes que sospeche o detecte que hayan participado de cualquier manera fraudulenta.

Si se evidenciase que los ganadores o suplentes no cumplen con los requisitos exigidos en las Bases, o bien no acreditaran lo que les sea solicitado, su participación se considerará nula y quedarán automáticamente excluidos de la Promoción perdiendo todo derecho sobre el premio otorgado en virtud de esta Promoción.

El premio entregado no será susceptible de cambios, alteraciones o compensaciones a petición de los ganadores, no pudiendo ser canjeado por cualquier otro producto ni por dinero. CIVITATIS se reserva el derecho, si concurre justa causa y previa comunicación en legal forma, de efectuar cualquier cambio, suspender o ampliar esta Promoción.

Se establece un plazo de quince (15) días naturales desde la fecha de la concesión del premio, para efectuar cualquier reclamación motivada por esta Promoción. Una vez transcurridos los quince (15) días naturales desde la fecha de concesión del premio, se procederá a la formalización y/o gestión del envío del premio.

Se deja constancia por el presente documento de que los Participantes no tienen que abonar, como consecuencia del sorteo propuesto, cantidad adicional alguna a CIVITATIS.

CIVITATIS se reserva, en caso de obligada necesidad, el derecho de sustituir los premios por otros de similares características.

Quinta. – EXCLUSIÓN DE RESPONSABILIDAD.

A título enunciativo y no limitativo, CIVITATIS no se responsabiliza de las siguientes circunstancias:

• Del uso que hagan el ganador respecto del premio objeto de la presente Promoción.
• De los daños y perjuicios de toda naturaleza que puedan deberse a la falta temporal de disponibilidad o de continuidad del funcionamiento de las redes de telecomunicaciones.
• De los servicios prestados por cualquier otra entidad con la que CIVITATIS colabore en la prestación de los servicios al ganador, como consecuencia de los premios entregados, así como los derivados de una actuación negligente en el disfrute de los mismos.
• De los casos de fuerza mayor o caso fortuito que pudieran impedir la realización de la Promoción o el disfrute total o parcial de su premio. En caso de que esta Promoción no pudiera realizarse, bien por fraudes detectados en la misma, errores técnicos, o cualquier otro motivo que no esté bajo el control de CIVITATIS y que afecte al normal desarrollo de la Promoción, CIVITATIS se reserva el derecho a cancelar, modificar, o suspender la misma.

Sexta. – LIMITACIÓN EN EL CONTENIDO DE LAS FOTOS Y LOS COMENTARIOS.

• Discriminación: En ningún caso podrán realizarse con una intención que pretenda discriminar a terceras personas y que vulneren los principios del derecho al honor, a la intimidad personal y familiar, a la propia imagen y a la dignidad de la persona. Se prohíbe cualquier tipo de contenido discriminatorio ya sea por motivos de raza, sexo, religión, opinión, nacionalidad, discapacidad o cualquier otra circunstancia personal o social.
• Actividades ilegales: No podrán incluir contenido que promuevan actividades ilegales o que incorporen contenido obsceno o difamatorio.
• Contenidos autodestructivos: Se prohíbe incluir contenido que promueva el consumo de sustancias estupefacientes o que pudiera incitar a trastornos alimenticios y a la autolesión.
• Violencia: Está expresamente prohibido participar con fotos y comentarios que promuevan la violencia y/o que incluyan sin limitación alguna, la violencia sexual o la violencia contra animales y personas.
• Contenido degradante: No están permitidas fotos y comentarios que sean intimidantes, amenazantes degradantes o que de cualquier manera promuevan la violencia contra una persona o un colectivo determinado.
• Contenido sexual: Está expresamente prohibido incorporar cualquier tipo de contenido sexual.

En caso de que se acreditara que cualquiera de los Participantes de la Promoción incurriera en alguna de las limitaciones establecidas en el presente apartado, CIVITATIS se reserva el derecho de excluir a dicho Participante de la presente Promoción.

CIVITATIS no se responsabiliza de los daños ocasionados por el contenido incluido en las fotografías publicadas por los Participantes en la Promoción, y que en un momento dado pueda herir la sensibilidad de otros Participantes, por lo que CIVITATIS declina toda la responsabilidad legal y jurídica de todas las fotografías y descripciones.

Séptima. – PROTECCIÓN DE DATOS PERSONALES

CIVITATIS se toma muy en serio la protección de su privacidad y de sus datos personales. Por lo tanto, su información personal se conserva de forma segura y se trata con el máximo cuidado.

De conformidad con lo establecido en el REGLAMENTO (UE) 2016/679 DEL PARLAMENTO EUROPEO Y DEL CONSEJO de 27 de abril de 2016 relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos y por el que se deroga la Directiva 95/46/CE (en adelante, “RGPD”) y en la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales (en adelante, “LOPDGDD”), cada Participante con la aceptación de estas Bases Legales consiente que los datos personales facilitados para la participación en esta Promoción sean incorporados a una base de datos titularidad de CIVITATIS para tramitar la participación del Participante y para comunicarle el premio en caso de que resultase ganador.

CIVITATIS mantiene la seguridad adecuada conforme al RGPD y la LOPDGDD, y ha establecido todos los medios técnicos a su alcance para evitar la pérdida, mal uso, alteración, acceso no autorizado y robo de los datos que los Participantes faciliten a través de la Promoción, sin perjuicio de informarles de que las medidas de seguridad en Internet no son inexpugnables. CIVITATIS se compromete a cumplir con el deber de secreto y confidencialidad respecto de los datos personales contenidos en el fichero automatizado de acuerdo con la legislación aplicable, así como a conferirles un tratamiento seguro en las cesiones que, en su caso, puedan producirse.

El Participante garantiza que los datos personales facilitados son veraces y se hace responsable de comunicar a CIVITATIS, cualquier modificación de los mismos. El Participante responderá, en cualquier caso, de la veracidad de los datos facilitados, reservándose CIVITATIS el derecho a excluir de la Promoción a todo Participante que haya facilitado datos falsos, sin perjuicio de ejercitar las demás acciones que procedan en Derecho. Se recomienda tener la máxima diligencia en materia de Protección de Datos mediante la utilización de herramientas de seguridad, no pudiéndose responsabilizar a CIVITATIS de sustracciones, modificaciones o pérdidas de datos ilícitas.

Octava. – CAMBIOS Y ACEPTACIÓN

CIVITATIS se reserva el derecho de modificar o ampliar estas bases promocionales, en la medida que no perjudique o menoscabe los derechos de los Participantes en la Promoción.

La participación en la Promoción comporta la íntegra aceptación de estas Bases Legales por parte de los Participantes que se inscriban en la presente Promoción, las cuales podrán protocolizarse en Acta autorizada por un Notario y estarán a disposición de cualquier persona que desee consultarlas.

Novena. – LEGISLACIÓN APLICABLE Y JURISDICCIÓN

Estas Bases Legales se interpretarán y regirán de conformidad con la ley española. Serán competentes para resolver cualquier reclamación o controversia que pudiera plantearse en relación con la validez, interpretación o cumplimiento de estas bases los Juzgados y Tribunales de la ciudad de residencia de los Participantes.

One. -ORGANISING COMPANY, OBJECTIVE, DURATION AND CONDITIONS.This promotion is organised by Civitatis Tours S.L. (henceforth, “CIVITATIS”), with registered business address at Calle Coloreros 2, 28013, Madrid, Spain, and N.I.F [tax identification number] B- 86899440.

The winner of the prize will be chosen from those users who have complied with all participation requirements using the EasyPromos application. Any participant who has not completed every step of the Promotion will be automatically disqualified. Any profile flagged as false or found to commit fraudulent acts will also be automatically disqualified.Once CIVITATIS knows who the winner is, this will be communicated from the 21st March 2020 onwards, contacting the winner directly by email.The prize for this promotion includes:– €300 in Civitatis Wallet credit.Regards the conditions of the prize: (i) the prize is non-transferable and may not be change for cash or another product, (ii) the prize may only be exchanged for CIVITATIS activities, always in accordance with the availability of said activities.If the winner cannot be found or contacted within seven (7) calendar days from when CIVITATIS announces the winner, the prize will be given to the next alloted winner and the first winner will irrevocably renounce their prize. Six. – LIMITATIONS ON THE CONTENT OF PHOTOS AND COMMENTS

• Discrimination:In no case can photos or comments include content which intentionally aims to discriminate third parties, or which violates the rights of honour, personal and family privacy, image rights or the rights of a person’s dignity. All content that is discriminatory regarding race, gender, religion, opinion, nationality, disability or any other personal or social circumstance is prohibited.
• Illegal activities: Content cannot be included which promotes illegal activities or which incorporates obscene or indecent content.
• Self-destructive content: Content which promotes the consumption of narcotic substances or which may encourage eating disorders or self-harm is prohibited.
• Violence: It is expressly prohibited to participate with photos and comments that promote violence and/or include, without limitation, sexual violence or violence against animals and people.
• Degrading content: Photos or comments that are intimidating, threatening, degrading or that promote violence against a person, or a determined group of people are prohibited.
• Sexual content: All kinds of sexual content are expressly prohibited.

Should it be deemed that any of the Participants in this Promotion have incurred any of the limitations established in this section, CIVITATIS reserves the right to exclude said Participant from the Promotion.CIVITATIS shall not be held liable for the damage caused by the content included in the photographs and comments published by the Participants in this Promotion, and which may at any point offend other Participants; as such CIVITATIS accepts no legal liability for the photographs and comments.Seven. – PERSONAL DATA PROTECTIONCIVITATIS takes privacy and data protection very seriously.
